Terms and Conditions
These Terms and Conditions govern your access to and use of the services provided by Xenox Servers (referred to as “Xenox Servers”, “we”, “us” or “our”) through our website. By purchasing or using any of our services you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Services
Xenox Servers provides web hosting, reseller hosting, control panel provisioning, server management, website design and related services. The scope, features and pricing of each service are described at the time of purchase and may be updated from time to time.
2. Accounts and Eligibility
You must provide accurate and complete information when creating an account or placing an order. You are responsible for keeping your account credentials confidential and for all activity under your account. You must be at least 18 years of age to use our services.
3. Acceptable Use
You agree not to use our services for any unlawful, abusive or harmful purpose. Prohibited activities include but are not limited to:
- Hosting or distributing illegal, infringing or malicious content
- Sending spam or engaging in phishing or fraud
- Attempting to gain unauthorised access to any system or network
- Consuming server resources in a way that degrades service for other users
We reserve the right to suspend or terminate any account that violates this policy.
4. Payments and Billing
All services are billed in advance for the chosen term. Goods and Services Tax is charged as required by law. Renewals are billed at the then-current rates. Failure to pay by the due date may result in suspension or termination of the service.
5. Client Data and Backups
Xenox Servers provides hosting infrastructure only. We do not access, control or store the content or data that you or your clients place on our services beyond what is technically required to host it, and all such data remains the property and responsibility of the respective client. You are responsible for maintaining your own backups.
6. Service Availability
We take reasonable steps to keep our services available and secure. We do not warrant uninterrupted or error-free operation and are not liable for downtime caused by factors beyond our reasonable control, including third-party data centres, upstream providers or events of force majeure.
7. Third-Party Services
Some services rely on third parties such as domain registrars, data centres and payment providers. Your use of those services may be subject to their own terms.
8. Suspension and Termination
We may suspend or terminate your service for non-payment, breach of these terms or unlawful use. You may cancel your service in line with our Refund and Cancellation Policy.
9. Limitation of Liability
To the maximum extent permitted by law, Xenox Servers shall not be liable for any indirect, incidental or consequential loss, including loss of data, revenue or profit. Our total liability for any claim shall not exceed the amount you paid for the service in the three months before the claim.
10. Indemnity
You agree to indemnify and hold Xenox Servers harmless from any claim arising out of your use of the services or your breach of these terms.
11. Governing Law
These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of Punjab, India.
12. Changes to These Terms
We may update these terms from time to time. The latest version will always be available on this page with the revised date.
